This agreement outlines the rights and responsibilities of both parties regarding the use of the Site. By accepting these Terms, both parties agree to fulfill their obligations completely, accurately, and in a timely manner, as required by this agreement.

1. Responsibilities

a. The Company reserves the right to modify prices, products, and services offered on the Site at any time. b. The Company agrees to provide the User with access to the services offered on the Site, except in cases of technical malfunctions. c. The User agrees not to engage in reverse engineering or any actions aimed at obtaining the source code of the Site. The User will be held liable for any damages caused to third parties and may face legal action. d. The User agrees not to produce or share content that is against public morals, illegal, harmful to the rights of others, misleading, aggressive, obscene, pornographic, infringing on personal rights, violating copyrights, or encouraging illegal activities. The User is solely responsible for any damages resulting from such actions. The Site authorities reserve the right to suspend, terminate accounts, or initiate legal proceedings in such cases. The Site authorities may also share information with judicial authorities if requested regarding user accounts or activities. e. The User is solely responsible for their interactions with other users or third parties on the Site.

2. Intellectual Property Rights

2.1. All intellectual property rights, registered or unregistered, including titles, business names, trademarks, patents, logos, designs, information, and methods on this Site, belong to the Company or the specified owner and are protected by national and international laws. Visiting or using the services on this Site does not grant any rights regarding these intellectual property rights. 2.2. The information on this Site cannot be reproduced, published, copied, presented, and/or transferred in any way. The Site, in whole or in part, cannot be used on another website without permission.

3. Confidentiality

3.1. The Company will not disclose personal information transmitted by users through the Site to third parties. This personal information includes name, surname, address, phone number, mobile phone number, email address, and any other information that can identify the User, referred to as "Confidential Information." 3.2. The User agrees that the Company may share their contact, portfolio status, and demographic information with its affiliates or group companies for marketing purposes, including promotions, campaigns, and announcements. This personal information can be used to determine customer profiles, offer personalized promotions and campaigns, and conduct statistical studies. 3.3. Confidential Information may only be disclosed to official authorities if requested in accordance with legal procedures and when required by mandatory legal provisions.

4. Disclaimer of Warranty: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY PROVIDES THE SERVICES ON AN "AS IS" AND "AS AVAILABLE" BASIS. THE COMPANY MAKES NO WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, REGARDING THE SERVICES OR THE APPLICATION (INCLUDING ALL INFORMATION CONTAINED THEREIN).

5. Registration and Security

The User must provide accurate, complete, and up-to-date registration information. Failure to do so will be considered a violation of this Agreement, and the User's account may be terminated without notice. The User is responsible for the security of their password and account on the Site and third-party sites. The Company cannot be held responsible for data loss, security breaches, or damage to hardware and devices resulting from the User's actions.

6. Force Majeure

Neither party shall be liable for any failure to perform their obligations under this Agreement due to events beyond their control, such as natural disasters, fires, explosions, civil wars, wars, uprisings, public movements, mobilization announcements, strikes, lockouts, epidemics, infrastructure and internet failures, or power outages ("Force Majeure Events"). During such events, the rights and obligations of the parties under this Agreement shall be suspended.

7. Severability and Enforceability

If any provision of this Agreement is deemed invalid, in whole or in part, the remaining provisions shall remain valid and enforceable.

8. Modifications to the Agreement

The Company may modify the services offered on the Site and the terms of this Agreement at any time. Modifications will be effective from the date of publication on the Site. It is the User's responsibility to follow these changes. By continuing to use the services, the User accepts these modifications.

9. Notices

All notices regarding this Agreement will be sent to the Company's known email address and the User's email address provided in the membership form. The User agrees that the address provided during registration is the valid address for notification and will notify the other party in writing within 5 days if it changes. Otherwise, notifications sent to this address will be considered valid.

10. Evidence Agreement

The parties' books, records, documents, computer records, and fax records will be accepted as evidence under the Law of Civil Procedure No. 6100 in case of any disputes arising from the transactions related to this Agreement. The User agrees not to object to these records.

11. Dispute Resolution

Independent Courts and Enforcement Offices are authorized to resolve any disputes arising from the implementation or interpretation of this Agreement.

Governing Law

This Agreement shall be governed by and construed in accordance with the laws of Turkey.
